The defense is permitted pursuant to the CCP Section 2032, to take a Defense Medical Examination. You can be certain that the defense will take advantage of this tactic and use their doctor to perform this examination as well as take an informal deposition of your client when he/she is alone and unprepared. In addition, the defense will use their doctor at trial in an attempt to defeat your client's damage claim.
